McFarland Enterprises LLC is a residential rental business operating in Buffalo and Western New York. It owns and operates residential rental property directly and through its wholly owned subsidiary, Highbrook Estates LLC. All text messages described in this policy are sent by McFarland Enterprises LLC from (716) 599-5998, whichever property the message concerns.
2. Information we collect
- Contact information you provide to us: name, mailing address, email address, and mobile telephone number.
- Rental application information you submit to us or through our application provider.
- Tenancy records: lease documents, maintenance requests, entry and inspection records, and rent payment history.
- Communications between you and us, including text messages, emails, and call records.
3. How we use your information
We use the information above only to operate the rental relationship: to evaluate rental applications, schedule showings, administer leases, receive and respond to maintenance requests, schedule technician visits and inspections, deliver notices, and administer rent and account matters. We do not use your information for advertising, and we do not sell it.
4. Data sharing
- Customer data is not shared with 3rd parties for promotional or marketing purposes.
- Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.
We share other information only where it is necessary to operate the tenancy or where the law requires it: with maintenance contractors performing work you requested, with our rent collection and accounting providers, and with government authorities where legally required.

We send text messages from (716) 599-5998 to current tenants and rental applicants who have opted in. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of renting, applying, or of any purchase, and you may withdraw it at any time.
We do not share your mobile number or SMS consent with third parties or affiliates for their marketing purposes.

- The messaging program consists of operational text messages from McFarland Enterprises LLC to current tenants and rental applicants at the residential properties it owns and operates, including maintenance request confirmations and technician scheduling, showing and inspection appointment reminders, application and lease status, and rent and account notifications. No marketing or promotional messages are sent.
- You can cancel the SMS service at any time. Just text 'STOP' to the phone number from which you received messages. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

- Carriers are not liable for delayed or undelivered messages.

Tenants and rental applicants opt in by sending the keyword JOIN from their own mobile phone to (716) 599-5998. They learn the keyword from this page and from a written notice we deliver to residents, post at the management office, and announce through the resident portal. No one is enrolled unless they send the keyword themselves. You may withdraw consent at any time by replying STOP to any message, or by contacting us at support@mcfarland-enterprises.com or (716) 599-5998. We honor STOP requests immediately.
Text messages are not legal notice
Text messages are a convenience. They do not replace any notice that your lease or New York law requires to be given in writing and delivered or mailed, and no text message from us should be treated as such a notice.
Retention and security
We retain tenancy and application records for as long as needed to operate the tenancy and to meet our legal, tax, and recordkeeping obligations, and we take reasonable measures to protect them against unauthorized access.
